Video Conference System (LiveOn General) Use Agreement
The User may use the Video Conference System (LiveOn) provided by Japan Media Systems Corp. in accordance with this use agreement.
By using this service, you accept all the terms and conditions of this agreement and agree to abide by them. The terms and conditions of this agreement may be changed as necessary.
¦ About LiveOn Provided by Japan Media Systems Corp.
To use LiveOn, you must purchase LiveOn, install it on your computer and connect to the Internet. It is the user’s responsibility and expense to prepare the necessary equipment, software and Internet connection, and setup and operate them
correctly. LiveOn requires a monthly use fee.
¦ User Registration
User registration is required to use LiveOn. User registration is done on the new registration screen after installing the LiveOn you purchased on your computer. Be sure to comply with the following conditions when using LiveOn. On the User Registration Form, enter valid and accurate personal data about yourself, and complete all the required items. You can correct this data at anytime, as needed to keep it valid and accurate. If Japan Media Systems Corp. determines that there is any violation of the above, or valid and accurate data has not been provided, it will delete the applicable user ID and refuse service.
¦ The user is Responsible for the Protection of His/her ID and Password. It is the sole responsibility of the user to register and protect his/her Password. Violations of the use of the ID and Password, is the responsibility of the user possessing the applicable ID. Japan Media Systems Corp. cannot guaranty against damage caused by disclosure and improper use.
¦ Obligations of the Registered User
Users are prohibited from engaging in the below conduct (improper use).
Conduct that is a Violation of law, conduct that impairs others rights, and conduct that causes others economic or psychological damage
Conduct that is threatening or that damages another person’s reputation
Conduct that violates another person’s privacy, harassment or conduct that slanders another person
Conduct that is obscene or disorderly, impolite or vilification
Conduct that is hateful or discriminatory
Conducts that informs of a service that is unethical to display, disclose provide or send to another person
Conduct that are harmful to minors or using another person’s name
Conduct that transmits (send) by uploading publishing, e-mailing etc.
Content containing computer virus, computer code, file or program that is designed to obstruct destroy or restrict the computer software, the hardware, the server that operates this service, the transmission line or transmission devices
Conduct that interfere with users conversation on the screen, and adversely effect another user’s connection, display, operation or attempted input
Conduct that interferes with or disrupt the service or server connected to the service and the network, or do not conform to the service use conditions and operational procedure agreement of the network connected to the service
Regardless of weather it is unintentional or accidental or not conducts that is in violations of the law
Conduct such as stalking, that harasses another person regardless of method
Conduct that collects or stores other users private information
Japan Media Systems Corp., does not inspect content in advance, but if it is determined to be necessary, the transmission (sending) of content that announce a service will be deleted, or the place where it appears will be changed. Also
included in Japan Media Systems Corp., right to delete content is the right to delete content that is in violation of this agreement and content that we decide is a problem for Japan Media Systems Corp.
If Japan Media Systems Corp. determines that it is necessary as a legal requirement, as part of a legal procedure, to obtain compliance with this agreement, as is necessary to support claim against content that infringes on a 3rd person rights, or another user’s livelihood, rights and business etc. and to maintain safety public or public welfare it can save or disclose that content and information involved in that content.
The user, uses this service with the understanding that because the process of receiving the service transmission (sending) that includes your content requires it to go via a variety of connecting networks, devices, and equipment, changing data and signals etc. may be necessary to connect and route it.
¦ Cautions on International Use
Understand well that the Internet is a medium that is used across international boundaries, and that the conduct of the user and what sort of content is allowed, must be in accordance with the laws and regulations of the country and region of use. Especially, when transmitting (sending) technological information from his/her country of residence to another country the user agrees to observe all laws and ordinances.
¦ Compensation of Japan Media Systems Corp.
Trouble generated by content, the use of it, and connections etc, transmitted (sent) during the use of LiveOn by users or between a user and a 3rd party will be settled at the user’s cost and responsibility.
Also, if Japan Media Systems Corp. bares any cost or damage related to the above problem, the user will indemnify Japan Media Systems Corp. (Including legal fees paid by Japan Media Systems Corp.) for applicable costs etc.
LiveOn has no responsibility for any problems with the computer itself, peripheral equipment, and programs installed in the computer, or the transmission line etc. generated during the use of LiveOn.
¦Resell and Divert LiveOn
Except offical contract with Japan Media Systems Corp., the user is prohibited from using LiveOn or accessing LiveOn, regardless of entire and part of systems, for commercial purpose or other purposes(regardless of styles of use, replay, replicate, copy, sell, resell, etc.).
¦ LiveOn Content Change
If Japan Media Systems Corp. determines that content change is necessary, it can change the content of LiveOn at any time without notifying the user. Even if Japan Media Systems Corp. has changed the content of LiveOn, it has no responsibility to the user for any problems generated.
¦ Deletion etc. of a Registered ID
If Japan Media Systems Corp., determines that it is necessary, it will delete the users ID Password and account, prohibit use of LiveOn, and retains the right to delete content in the service. This Japan Media Systems Corp., right will be also enforced if Japan Media Systems Corp. determines that the user is in violation of the content or meaning of the use agreement or has from the standpoint of the use agreement engaged in inappropriate conduct.
If Japan Media Systems Corp., determines that it is necessary, to stop providing LiveOn to a specific user, Japan Media Systems Corp. can make the applicable users ID and account invalid, and along with deleting related information and files, prohibit any future use of LiveOn by the applicable user.
In this case, Japan Media Systems Corp., has no responsibility to the applicable user or any 3rd party regarding stopping LiveOn service.
In any of the above cases Japan Media Systems Corp. has no obligation to the user for compensation for damages, or new monetary obligation.
¦ Usage Fee Refund
The usage fee that the user has paid for the purpose of using LiveOn provided by Japan Media Systems Corp. is not refundable regardless of the reason.
¦ Japan Media Systems Corp. Property Rights
With the exception of what the user transmits (sends) the property rights concerning the content, the individual information (data) and aggregate information included in LiveOn belongs to Japan Media Systems Corp. or the business partner that provides the applicable content to us.
The intellectual property rights to the service and all software used for service related use (hereafter called software) is property rights and business secrets protected by law.
The software, programs and content provided in LiveOn is protected by Japan's Copyright Act, trademark regulations, and design regulations.
The user, agrees to not copy, delete, make public, transmit, distribute, transfer, loan, translate, alter, transfer the license agreement to another person, print, or reuse this service, software or the content included in it(regardless whether 1 part or all) without prior written permission from Japan Media Systems Corp.
Also, the user agrees in advance that if the user violates these conditions, the agreement contents, individual information (data) information in aggregate and software and copies, makes public, transmits, distributes, transfers, loans, translates, alters or transfers the license agreement to another person, prints, or uses reused material, Japan Media Systems Corp. has the right of prohibition, and the right to claim the amount of any profit the user gained from the violation of the agreement.
In that case, Japan Media Systems Corp. will regard a sum 100 times the LiveOn product purchase price as the equivalent profit value and the user cannot raise objection to this.
Japan Media Systems Corp. licenses the user the non-exclusive, and individual right to install the provided software content 1 time on 1 computer. However, the user is prohibited from copying, altering, changing, secondarily using, reverse engineering, reverse assembly, etc method decoding or consenting to reactivation. If there is misconduct of the above Japan Media Systems Corp. can seek by a method identical to the previous paragraph, compensation equal to the profit and request prohibition.
¦ Concerning the guaranty
The use of LiveOn is the sole responsibility of the user.
The use of LiveOn to obtain anything by downloading or any other method is including the downloading is done as the sole responsibility of the user. Any risk is the sole responsibility of the user, and any damage as a result of this conduct is the sole responsibility of the user. Even if the user has received advice or information directly from Japan Media Systems Corp. or through this service there is no guaranty beyond what is provided for in this agreement.
Furthermore, as the applicable advice and information is based on conveyed and limited information from our users, there is no guaranty concerning the authenticity, suitability, and accuracy of the content of the applicable advice and information itself.
¦ Japan Media Systems Corp. liability limits
The user agrees that Japan Media Systems Corp. has no responsibility for any damages caused by any of the following cases.
(1) The user used LiveOn or was unable to use LiveOn.
(2) Exchange of goods obtained from information from trading through LiveOn, or cost from change of service.
(3) Improper access or change to the user’s sent or received transmission or data.
(4) A transmission (send) from or conduct of a 3rd part during use of LiveOn.
(5) Caused or arising from other service related items or associations.
¦ Notification and Contact
In the event that Japan Media Systems Corp. determines that notifying or contacting users with registered ID’s is necessary, it will be done by e-mail or postal mail.
If the user needs to notify or contact Japan Media Systems Corp., send e-mail or postal mail to the address displayed in the contact window.
The legal relationship produced between Japan Media Systems Corp. and the user related to LiveOn and this agreement, and the legal basis for the, establishment, validity, discharge, and interpretation of these stipulations is based on Japanese law.
If there is a dispute produced between Japan Media Systems Corp. and the user related to LiveOn and this agreement the Summary Court of the Tokyo Regional Court will be the sole Special Arbitration Court.
¦ Abolition of LiveOn, and Change of this Agreement
Japan Media Systems Corp. may change LiveOn or this agreement at its discretion without prior notice or prior user consent. Japan Media Systems Corp. may at any time, using the procedure provided by LiveOn announce these changes to the user, and has no responsibility for any damages caused by these changes etc.
¦ Change of the URL
Japan Media Systems Corp. may change the LiveOn URL and contents without notice.
¦ Agreement Violation
